Petit Somme Terms of Use
This English text is a courtesy translation. The French version prevails.
These terms apply to the Petit Somme iPhone app ("the app") and its website. They are a contract between you and Erez Golan, a sole trader established in Israel, Iben Gabirol 131, Tel Aviv, Israel ("we"). Contact: support@petitsomme.com.
By using the app you accept these terms and the Privacy Policy. If you don't agree, please don't use the app.
1. What the app is for
Petit Somme helps parents log their baby's sleep, feeds and diapers and organise the day (naps, bedtime, childcare days) from what you enter and from general published guides.
- The log (naps, nights, feeds, diapers) and an age-based guide are free.
- The personal plan, the "Pourquoi" (why) explanations, the evening tips and childcare days are part of the paid subscription (section 5).
2. What the app is not: no medical advice
Intended purpose. Petit Somme helps parents log their baby's sleep and organise the day (naps, bedtime) from their own entries and general published guides. It makes no diagnosis, doesn't monitor health and doesn't replace advice from a health professional.
- Guides and estimates are general. They can be wrong. Every baby is different.
- The app is not a medical device and not a baby monitor: it does not watch your baby, your baby's breathing or sleep in real time.
- Notifications are organisation reminders, not alerts.
- For any question about your baby's health or sleep, talk to your doctor, midwife, health visitor or the local child-health service (PMI).
- In an emergency, call 15 (SAMU) or 112. If you are worried, call your doctor, even if nothing seems "serious enough".
- To put your baby to sleep safely, follow the official guidance (links in the app, "Couchage en sécurité" card). The app doesn't replace it.
3. Your account and your data
- There is no Petit Somme account. In version 1.0, your data stays on your iPhone (see the Privacy Policy). If you back up your iPhone (iCloud or a computer), Apple's backup includes the app's data, under Apple's terms.
- You must be an adult and a parent, legal guardian or someone a parent has authorised. You enter the information about the baby on your own responsibility.
- You keep ownership of what you enter. We don't use it for advertising and we can't access it.
- You can export or delete all your data in Settings at any time. "Delete all data" erases the data on the iPhone; we can't erase your Apple backups. This doesn't depend on a subscription.
4. Acceptable use
You agree not to:
- use the app unlawfully, or for the data of a child you aren't responsible for or authorised to enter;
- copy, decompile or work around the app, except as the law allows;
- bypass the subscription or technical protections;
- use the app as a medical monitoring or safety tool;
- disrupt the app or the services it relies on.
5. Subscription
- Free: the log (enter, edit, export) and the age-based guide.
- Paid: the subscription unlocks the personal plan, the "Pourquoi" explanations, evening tips and childcare days.
- Apple Family Sharing: it is available for both plans, subject to your Apple Family Sharing group's settings.
- Plans and prices: €34.99 per year (with a 7-day free trial) and €6.99 per month for the short plan. The prices shown in the app, taxes included, are the ones that apply. They are charged in your Apple account's currency.
- Payment: purchase goes through Apple only. Payment is charged to your Apple account when you confirm the purchase, or at the end of the free trial if you don't cancel.
- Auto-renewal: the subscription renews automatically at the same price unless you cancel at least 24 hours before the end of the current period.
- Free trial: offered on the yearly plan, in principle once per Apple account. If you cancel before the trial ends, you pay nothing.
- Cancel: iPhone Settings → your name → Subscriptions. Deleting the app does not cancel the subscription. You keep access until the end of the paid period.
- Refunds and withdrawal: Apple sells the subscription and handles refunds and withdrawal requests (reportaproblem.apple.com). We have no access to them. Your statutory consumer rights are unchanged.
- Price changes: if we raise the price, Apple informs you and, where required, asks for your consent. Without it, the subscription ends.
- Restore purchases: Settings › Subscription › "Restore purchases", or at the top of the subscription screen.
- After a subscription ends: the log and the free guide stay available. Your data remains yours: you can still export or delete it.
6. Intellectual property
The app, its name, logo, mascot, illustrations, texts and code belong to Erez Golan or his licensors. We grant you a personal, non-exclusive, non-transferable, revocable right to use the app on your Apple devices for your family's use. No other right is transferred.
7. "As is" service and liability
- The app is provided as is. We do our best to make it work well, but we don't promise uninterrupted or error-free service.
- Within the limits permitted by law, we are not liable for indirect damage, or for decisions you make based on the app's estimates.
- Nothing in these terms excludes or limits our liability for bodily injury, gross negligence or wilful misconduct, or the rights the law gives you as a consumer, including the legal guarantee of conformity for digital content and services (articles L. 224-25-1 ff. of the French Consumer Code).
- Apple's services (App Store, and your iPhone backup if you make one) are Apple's responsibility. We don't control their availability or security.
8. Suspension and end
You can stop using the app at any time (remember to cancel the subscription, section 5). We may suspend access for a serious breach of these terms, telling you first where possible.
9. Changes
We may change these terms, for example if the app or the law changes. For an important change we tell you in the app at least 30 days before it applies. If you don't accept it, you can stop using the app and cancel your subscription. The current version and its number are always shown in Settings.
10. Governing law, mediation, disputes
- French law. If you are a consumer living in another EU country, you keep the protection of the mandatory rules of your country.
- Complaints. The app is free; the subscription is sold by Apple Distribution International Ltd. (Cork, Ireland), in its own name, through the App Store. For a payment, refund, withdrawal or cancellation, contact Apple (getsupport.apple.com), which sets out its own complaint routes in its terms. For a question about the app itself, write to us at support@petitsomme.com: we look for an amicable solution first.
- Courts: failing agreement, the competent courts are those the law provides. A consumer can bring the case before the court of their place of residence.
- If the French and English versions differ, the French version prevails.
11. Apple's minimum terms
The app is licensed, not sold. Apple's standard Licensed Application End User License Agreement applies, except where these terms protect you more. In addition, you acknowledge that:
- these terms are between you and us, not Apple. We alone are responsible for the app and its content;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price; Apple has no other warranty obligation for the app. Claims about conformity, product liability, consumer protection and intellectual property are ours to handle, not Apple's;
- you state that you are not located in a country under a US embargo and are not on a list of prohibited parties;
- you must comply with the terms of any third-party service you use with the app (for example your internet access agreement);
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you once you have accepted them.
